SMS MESSAGING TERMS AND CONDITIONS

‍1. Program Description

Resonateapp, Inc. ("Resonate AI," "we," "us," or "our") provides an AI-powered patient communication platform used by dental practices and other healthcare providers (each, a "Practice") to send text (SMS) messages to their patients and contacts. This policy governs text messages sent by Practices using the Resonate AI platform. The Practice sending your messages is identified in each message you receive.

When you opt in to receive text messages from a Practice through our platform, you consent to receive recurring automated text messages from that Practice at the mobile phone number you provide. The Practice is the sender of the messages and the party responsible for the content of the communications. Resonate AI delivers the messages on the Practice's behalf as a technology service provider.

2. Types of Messages

Messages sent through our platform may include:

  • Appointment reminders and confirmations — Reminders of upcoming visits, confirmation requests, and rescheduling options.
  • Treatment follow-ups — Post-visit care instructions and check-ins.
  • Recall and re-care notifications — Reminders that it is time for your next checkup, cleaning, or other routine care.
  • Billing and payment reminders — Notifications about outstanding balances, payment confirmations, and related account activity.
  • Practice updates — Office closures, schedule changes, and other operational communications.
  • Responses to your inquiries — Replies when you contact the Practice.

Marketing and promotional messages (such as special offers or promotions) are only sent if you provide separate, express written consent for marketing communications.

3. Message Frequency

Message frequency varies. The number of messages you receive depends on your appointment schedule, treatment plan, and your interactions with the Practice. You will not receive more messages than are reasonably necessary to support your care and account.

4. Message and Data Rates

Message and data rates may apply. The cost of text messages depends on your mobile carrier and your wireless plan. Neither Resonate AI nor the Practice charges any fee for sending or receiving text messages through this program, but your mobile carrier's standard messaging rates will apply. Please contact your wireless carrier for details about your text messaging plan.

5. How to Opt In

You may provide consent to receive text messages through one or more of the following methods:

  • Completing an opt-in form on the Practice's website or on a Resonate AI-hosted intake page.
  • Providing your phone number and consent on a patient intake or registration form at the Practice.
  • Texting a designated keyword (such as START or JOIN) to the Practice's SMS phone number.
  • Providing verbal consent during a phone call or in-person visit, which will be documented and confirmed via a text message.

Your consent is specific to the Practice you are opting in to hear from and is not transferable or assignable. Opting in to receive messages from one Practice does not constitute consent to receive messages from any other organization or program.

Your consent is not a condition of purchasing any goods or services.

6. How to Opt Out

You may opt out of receiving text messages at any time. To opt out:

  • Reply STOP (or UNSUBSCRIBE, END, QUIT, or CANCEL) to any message you receive.
  • You may also contact the Practice directly by phone or email to request removal from a messaging list.

After you opt out, you will receive a one-time confirmation message acknowledging your request. You will not receive any additional marketing or recurring messages from that Practice through this program unless you re-opt in. Opting out of text messages does not affect your ability to receive care from the Practice.

8. Carrier Liability

Carriers are not liable for any delayed or undelivered messages. Message delivery is subject to effective transmission from your network operator and is outside of our control.

9. Supported Carriers

Our messaging service is compatible with all major US mobile carriers, including AT&T, Verizon Wireless, T-Mobile, Sprint, U.S. Cellular, and their respective affiliates and MVNOs. Carriers are not liable for delayed or undelivered messages.

10. Privacy

Your privacy is important to us. Please review the Resonate AI Privacy Policy at https://www.resonateapp.com/practice-privacy-policy for full details on how information collected through the messaging program is used and protected.

All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the text messaging services.

We do not sell, rent, share, buy, or otherwise transfer mobile phone numbers or SMS opt-in consent data to any third party for marketing or promotional purposes. Information is only shared with messaging aggregators, carriers, and service providers as strictly necessary to deliver messages.

11. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) and own the mobile phone number you provide, or have the express consent of the account holder, to opt in to the messaging program. If you are under 18, you must have your parent or legal guardian's permission to participate.

12. Changes to These Terms

We may modify these Terms from time to time. Changes will be posted at https://www.resonateapp.com/sms-terms-of-service and will become effective upon posting. Your continued participation in the messaging program after any changes constitutes acceptance of the modified Terms. We will use commercially reasonable efforts to notify you of material changes.

13. Regulatory Compliance

Our messaging program is designed to comply with applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, the CTIA Messaging Principles and Best Practices, and A2P 10DLC requirements for application-to-person messaging in the United States.
